This Privacy Policy (hereinafter the “Privacy Policy”) applies to the use of the services described in the Terms and Conditions provided through the website https://app.cuotaq.com/ (hereinafter, the “Website” and/or “Platform”), by the Contracting Party, as defined below (hereinafter, “CUOTAQ” and together with the User, the “Parties” and each of them, the “Party”) for the purposes of offering the User information related to the Platform offered by CUOTAQ through which it offers the following services (hereinafter, the “Services”):
CUOTAQ Service, whose specifications are detailed in Chapter I of the Terms and Conditions.
Mere access to the Website and/or use of the Services confers upon the person doing so the status of CUOTAQ user (hereinafter the “User”) and expresses full and unreserved acceptance of each and every one of the clauses of the Privacy Policy in the version published by CUOTAQ at the time the User accesses the Website or uses the Services. Consequently, the Privacy Policy shall constitute a valid and binding agreement between the User and CUOTAQ in relation to privacy. Likewise, the use of the Service expresses the User’s full and unreserved acceptance of the Terms and Conditions of use of the Services (hereinafter the “Terms and Conditions”) published by CUOTAQ on the Website.
BEFORE BROWSING AND/OR USING THE WEBSITE AND/OR THE SERVICES, PLEASE READ THIS PRIVACY POLICY CAREFULLY. IF THE USER DOES NOT AGREE WITH THIS PRIVACY POLICY, THEY MUST REFRAIN FROM USING THE WEBSITE AND/OR THE SERVICES.
CONTROLLER OF YOUR PERSONAL DATA
The controller of your personal data is CUOTAQ. CUOTAQ or “Contracting Party” herein shall be understood to mean the party identified in the table below, based on your Account Country. If you replace your Account Country with one associated with a different Contracting Party identified below, you agree that these Terms and Conditions shall be assigned to the new Contracting Party without any action being required by either Party.

“Account Country” is the country associated with your Account. If you have provided a valid tax identification number in connection with your Account, your Account Country will be the country associated with your tax identification. If you have not provided a valid tax identification number, your Account Country will be the country in which your billing address is located. For CUOTAQ, the privacy of the User's personal data is very important. COLLECTION OF USER INFORMATION. PURPOSES OF PROCESSING PERSONAL DATA.
CUOTAQ may request the User to store the following personal data for the provision of its Services: (i) name and surname and/or company name; (ii) email address; (iii) Tax identification number, DNI and/or CUIT; (iv) telephone number; (v) place of employment; (vi) name and billing address; (vii) CBU data (through third parties authorized to store such data); (viii) credit and/or debit card number and/or bank account number and/or virtual wallet (through third parties authorized to store such data); (ix) the data of the persons within the organization who will use the Services (x) personal credentials in order to enable the connection of the platform to each of the card administrators or online payment gateways, such as: (a) merchant number, (b) merchant username and (c) password, for each of the cards or payment gateways that the User wishes to control through the user credentials system of processing sites (through third parties authorized to store such data) (all of them hereinafter, the “Personal Data”).
CUOTAQ processes your personal data only thanks to the express consent that the User grants by accepting this Privacy Policy through the corresponding check box or button on the Website.
CUOTAQ may also request demographic information and unique identifiers in order to offer you a more personalized experience or to verify your passwords. The information collected during the use of the Services may remain stored after your trial or subscription period.
2.2. The purposes of processing the Users' Personal Data are:
To provide the Services offered through the Platform and to carry out operations such as, but not limited to, settlements and chargebacks and/or debits from the User's account;
To improve the quality of the service provided through the Website. CUOTAQ's storage of the IP number of the User's devices allows it to identify the User when accessing their individual accounts when these have been contracted with CUOTAQ. It also facilitates the diagnosis of any connection problems that may arise on the Website, improving the quality of the Service, diagnosing problems with the server, improving its performance, analyzing trends and managing the service.
The IP (Internet Protocol) number or address is a numerical identification that distinguishes an electronic computer device (be it a computer, a personal telephone with network access, a tablet, a PDA, etc.) that connects to a computer network (for example, the Internet).
Research or benchmarking purposes. These data may only be used in aggregate form and without direct references. This type of collective data allows us to evaluate the product and improve its quality to offer an excellent service that meets the needs of the User.
To offer the User a personalized Service, which is adapted to their needs to provide the best possible experience and greater benefits.
To manage any type of query that the User may make through our contact forms located on the Website or through our corporate email addresses.
To send you, either through traditional means, email, or social networks, our newsletters and circulars about CUOTAQ news, its services and events.
To carry out statistical analysis and market studies that allow us to improve our services.
The User accepts that CUOTAQ may collect information from them using cookies and tags, as well as that information provided by the User through the forms on the Website when registering and/or using the Services described in the Terms and Conditions of the Website.
The Service provided by CUOTAQ requires voluntary information provided by the User. CUOTAQ needs to validate the data provided by the User for the purposes of providing the Service, such as, but not limited to, the granting of credits by itself or by third parties as it decides. For such validation, CUOTAQ makes queries to public and private databases, specialized companies, government agencies and credit centers, among others, that allow the verification of the veracity of the data. Acceptance of these Privacy Policies implies your express consent that authorizes CUOTAQ to make such queries.
USE OF COLLECTED USER INFORMATION.
CUOTAQ will store and use the information provided by the User and that collected by CUOTAQ for the maximum period established by applicable law in order to analyze it and to be able to provide Users with the best possible Service.
CUOTAQ will not sell, rent or negotiate any Personal Data of the User to any third party for commercial purposes, under any other manner than that indicated in this document. Any person who has provided personal contact information through the CUOTAQ Website may send an email to ventas@cuotaq.com in order to update, delete and/or correct their personal contact information. CUOTAQ will respond to such request within 5 (five) days following receipt of the same via email.
CUOTAQ will use the information provided by Users and that collected by CUOTAQ to analyze the conduct and behavior of Users as such, such as their geographic locations, their sessions of use, permanence on the Website, frequency of use, in order to try to improve its Service and try to provide them with better solutions to their needs. Likewise, it will use information between ranges regarding the User's sales volume, without reporting specific data, in order to transfer it to third parties that may offer the User greater credit opportunities.
CUOTAQ may assign, transmit and/or transfer Personal Data and personal information to the Agents named below, with whom it has signed and/or signs agreements that guarantee the protection of the User's personal data. The information may be used by CUOTAQ and shared with third parties that it decides, only in an aggregate manner, in order to protect the privacy of the Users. This makes it possible to offer Users data on the sector, field, location or variable to be considered, as well as better commercial offers and thus provide a better User experience.
CUOTAQ may share personal information with service providers or outsourcing companies or with companies with whom CUOTAQ has a collaboration or alliance relationship, which contribute to improving or facilitating the operations offered through the Service. In any case, CUOTAQ will make its best efforts to ensure that the privacy of the shared information is protected in accordance with the laws in force at all times. In the cases that apply, CUOTAQ will try to sign express agreements regarding data protection and information privacy. Without prejudice to this, CUOTAQ will not be responsible for damages caused by such companies and/or websites regarding their duty to protect, keep confidential and keep private the data they handle.
The CUOTAQ Website may contain links to other websites that are not owned by CUOTAQ. Consequently, CUOTAQ will not be responsible for the actions of such websites, to which this Privacy Policy will not apply. We recommend that you examine the privacy policy in detail on those websites to understand the information collection procedures they use and how they protect your personal data.
CUOTAQ will retain the Personal Data provided and will use your personal data only for as long as necessary to fulfill the purposes described in the previous section.
Once the relationship between the Parties has ended, for whatever reason, CUOTAQ reserves the right to retain the aforementioned information until the purpose of its processing is completed. After the aforementioned period, CUOTAQ will proceed to destroy the Personal Data.
CUOTAQ will use the information provided by Users and the information collected by CUOTAQ if requested by courts, national or international state bodies that so require and request it in the corresponding manner.
AGENT CUOTAQ employs services from other companies and persons to perform tasks on its behalf or obtains alliances with certain business partners (hereinafter, the “Agents”) and as a result of this, on certain occasions it may be necessary to share the Personal Data and/or information of the User with said third parties in order to provide the User with additional products or services through the Platform and/or through third party platforms in which the User is also a user. The Agents may offer, for example but not limited to, the elimination of repetitive information from customer lists, data analysis, marketing assistance, credit card payment processing, better commercial offers, offering credits. CUOTAQ may also provide your personal information to the Agents who will use it to verify aggregate usage data, with the prior authorization of the User through this document. In all cases in which CUOTAQ shares Personal Data and/or personal information with such Agents, the Agent is explicitly required to recognize and respect the privacy of Users in accordance with the rules established in this Privacy Policy and the Terms and Conditions of Service.
INTERNATIONAL DATA TRANSFER
Only to fulfill the purposes set forth in this Privacy Policy and for the purposes of providing the Service, CUOTAQ may disclose Personal Data and/or personal information, when necessary, to the authorities, CUOTAQ partners and other third parties, such as third party service providers used in connection with the Service, for example to perform marketing, advertising, communication, infrastructure and IT services, to personalize and improve our Service, to process credit card transactions or other payment methods. When CUOTAQ hires a service provider, it will provide the service provider with the information it will need to perform its specific function, which may include Personal Data and other information that the User provides through the Platform. These service providers are authorized to use Personal Data only when necessary to provide their services.
This is applicable to:
use an intermediary company to manage the billing process for the Services through credit cards and/or payment gateways or CBU. Such intermediary will always be a company specialized in the area and will not be able to store, retain or use the information provided, except for the sole purpose of managing payment and billing processing; offering or expanding the offering of third-party services through the Platform and/or third-party platforms in which the User is a user, such as, but not limited to, the credit services offered by MercadoPago.
In some cases, such as the Argentine Republic, personal information may be transferred outside the country to countries with the same or better levels of protection. In the event that personal information is transferred to countries with lower levels of protection, CUOTAQ will carry out these transfers subject to appropriate safeguards and security measures, such as the standard data protection clauses adopted in the respective agreements or approved by the applicable legal authority.
INFORMATION SECURITY
All information collected and stored by CUOTAQ is kept in a private corporate data center that complies with ISO27001 and FISMA security standards, which guarantee military-level restrictions for physical access to CUOTAQ servers. To provide a secure communication channel with CUOTAQ, 128-bit SSL (Secure Socket Layer) technology is used, a standard used in the banking industry.
Only employees who need specific information from Users to perform a specific job (for example, a customer service or technical support representative) have access to it. All of our employees are kept up to date on our privacy and security policies.
MINORS.
Although the Website and/or the Service are not directed to minors, in the event that a minor has access to them, their use must be supervised by parents, guardians or legal guardians. The Website and/or the Service are permitted only for those who are of legal age to contract and are not legally inhibited or in any way prohibited from exercising legal acts, rights and/or obligations. Given this, minors under 18 years of age are not permitted to access the Website and/or use the Service, nor are they permitted to provide any Personal Data or any other type of information.
CONFIDENTIALITY AND SECURITY OF INFORMATION.
CUOTAQ has adopted reasonable security measures to protect User information and prevent unauthorized access to their data or any unauthorized modification, disclosure or destruction thereof. The information collected by CUOTAQ or provided by the User will be kept strictly confidential. Access to Personal Data is restricted to those employees, contractors, operators, clients and representatives of CUOTAQ who need to know such data to perform their functions and develop or improve the Service. CUOTAQ requires the same standards of confidentiality from its suppliers. CUOTAQ does not allow access to this information to third parties other than CUOTAQ, except at the express request of the User.
Without prejudice to the foregoing, considering that the Internet is an open system, with public access, CUOTAQ cannot guarantee that unauthorized third parties may not eventually overcome security measures and use User information improperly. In any case, CUOTAQ maintains security and incident response plans to control incidents related to unauthorized access to the private information we collect and store.
CHANGES IN THE CORPORATE STRUCTURE.
CUOTAQ reserves the right to transfer the information collected in the event of a sale or merger of CUOTAQ, or an acquisition of CUOTAQ's main assets, or any other type of transfer of CUOTAQ to another entity and/or between CUOTAQ entities. In such event, CUOTAQ must adopt reasonable measures to ensure that such information is used in a manner consistent with the Privacy Policy.
USER RIGHTS OVER INFORMATION.
CUOTAQ will use all available means to facilitate access to the User about whom it has collected or stored personal information (“Right of Access”), as well as the rectification, modification or updating of said Personal Data (“Right of Rectification”), or even the cancellation of said Personal Data (“Right of Removal”), unless CUOTAQ may deny said requests (hereinafter, the “Requests”), in the event that it is obliged or has the right to retain said Personal Data in accordance with applicable legislation.
For such purposes, the User must send his/her Request by sending an email with the subject “Access to Personal Data” to ventas@cuotaq.com. CUOTAQ may require said User to identify himself/herself, which may be verified by CUOTAQ, as well as to specify the Personal Data to which he/she wishes to access, rectify or remove.
CUOTAQ may refuse to process Requests that are unreasonably repetitive or systematic, that require a disproportionate technical effort, that jeopardize the privacy of the User, or that are considered impractical, or for which it is not necessary to access the Data.
The service of access, rectification and removal of Personal Data will be provided by CUOTAQ free of charge, except in the case that it requires a disproportionate or unreasonable effort, in which case an administration fee may be charged.
In the event that the User considers that his/her rights have been violated under current personal data protection laws, the User will have the right to access, port, rectify or remove them free of charge to the applicable authority according to the country where the User is located. As an example, for Argentina, the applicable authority is the PUBLIC INFORMATION ACCESS AGENCY, located at Av. Pte. Julio A. Roca 710, 2nd Floor - City of Buenos Aires, URL www.argentina.gob.ar/aaip - email: datospersonales@aaip.gob.ar, Tel. + 5411-2821-0047. In the case of Europe, for example, the authorities applicable to Data Protection rights are independent public authorities that oversee the European Data Protection Regulation Website and its applicable laws. These authorities also provide expert advice on personal data protection issues and handle complaints filed in the event of any apparent violation of the General Data Protection Regulation (GDPR) and relevant national laws. Each Member State of the European Union has an applicable authority for the protection of personal data and if the User intends to make inquiries and/or complaints regarding the protection of his/her personal data, he/she must contact the applicable authority of the Member State where the User is located. Users may exercise the following rights with CUOTAQ:
Access. You have the right to access your information to find out what specific personal data we are processing. Rectification. You have the right to rectify any inaccurate personal data that we are processing. Deletion. You have the right to request the deletion of any personal data that you do not want us to continue processing. Objection. In certain circumstances, and for reasons related to your particular situation, you have the right to object to our processing of your personal data, in which case we will keep it blocked for the period described above. Limitation of processing. You have the right to request that the processing of your data be limited to those specific purposes that you wish. Portability. You have the right to receive the personal data that you have provided to us, in a structured, commonly used and machine-readable format, and to have it transmitted to another data controller other than CUOTAQ.
To exercise any of these, you must send a written communication to CUOTAQ, attaching a copy of your identity document or Passport.

EXCEPTIONS
Notwithstanding any other provision to the contrary in the Privacy Policy, CUOTAQ may disclose certain personal information of the User, when it believes in good faith that such disclosure is reasonably necessary to:
avoid legal liability; comply with a legal requirement, such as a search warrant, subpoena, or court order; comply with a request from a government or regulatory authority; and/or protect the rights, property, or safety of CUOTAQ, the User, or a third party.
CHANGES IN THE PRIVACY POLICY
CUOTAQ may modify the Privacy Policy at any time. New versions of the Privacy Policy will be notified by publishing said new version on the Website and notified through the contact methods that the User declares, where applicable.
